Legal Requirement for a Fire Risk Assessment

Fire risk assessments are a statutory requirement under the terms of the Regulatory Reform (Fire Safety) Order 2005, which further states that the assessment should be carried out by a ‘competent’ person with the necessary knowledge and training to do the job effectively.

The Fire Safety Order also states that businesses with five or more employees should keep a written record of any assessments. Reviews should be conducted annually, with full assessments carried out at least every five years. If the layout or purpose of the building changes, or an individual at particular risk is employed or housed between assessments or reviews, then the next assessment must be brought forward to address the new circumstances.

Is it a legal requirement to have a fire risk assessment?

Yes. Under the terms of the Regulatory Reform (Fire Safety) Order 2005, fire risk assessments should be carried out on any premises that do not count as a ‘single private dwelling’ (i.e. a private home).

Who can carry out a fire risk assessment?

Your fire risk assessment should be carried out by a ‘competent’ person – under the terms of the Fire Safety Order, that means someone who has the ‘sufficient training and experience or knowledge and other qualities’ to do the job properly. In a small business with minor fire risks and only a handful of employees, you could reasonably conduct your own fire risk assessment if you know what you’re doing. In most cases, however, you should get a qualified professional to do it in order to meet the requirements of the Fire Safety Order.

What is the penalty for not having a fire risk assessment?

All commercial premises can be inspected at any time by the fire and rescue service, who will want to see evidence of a recent assessment. Minor breaches of fire safety law can result in fines of up to £5,000, while more serious violations can result in unlimited fines and imprisonment.
